The decision about the intent to seek the death penalty in the federal case had been expected Monday but has been extended by the court. The U.S. Attorney General now has until April 17 to provide notice of intent, said federal prosecutor Steve Skrocki.
Wade, who was acquitted of murdering a woman in 2003, has been accused of killing his neighbor, nurse practitioner Mindy Schloss, in the summer of 2007 and using her ATM card to withdraw money from her bank account.
There is no death penalty under Alaska state law, but because of the nature of the crime, Wade could be eligible for the federal death penalty.
