After a review of Kott's finances provided in a private filing to the court, U.S. District Judge John Sedwick said Monday that the ex-legislator and flooring contractor from Eagle River was only borderline indigent.

"However, the expansion of this case arising from the United States' admitted, and remarkable, failure to timely provide all of the discovery required . . . stretches Mr. Kott's modest means too far," Sedwick wrote. He ordered the government to pay Kott's appellate attorney, Sheryl Gordon McCloud of Seattle, for work she does after July 1. Kott is responsible for her fees up to then, the judge said.

Kott and former legislator. Vic Kohring were freed from prison two weeks ago when prosecutors agreed the government failed to provide evidence favorable to the defendants prior to their 2007 trials, though they haven't publicly disclosed any details.
