Appeals hearing for ex-mayor set for Aug. 4 in Anchorage

FAIRBANKS -- A federal appeals court has scheduled a hearing for jailed former Fairbanks Mayor Jim Hayes.

Hayes and his wife, Murilda "Chris" Hayes, are serving time in federal prisons in Texas.

Jim Hayes was convicted of -- and his wife had previously pleaded guilty to -- central roles in funneling social service grants to the family's South Fairbanks nonprofit tutoring center and the church where Jim Hayes served as pastor.

Jim Hayes' appeal, working its way through the 9th U.S. Circuit Court of Appeals, is scheduled for Aug. 4 in Anchorage.

The appeal focuses on whether a district judge erred in declining to postpone Hayes' original trial early last year.

Anchorage attorney John Murtagh, who represents Hayes, has argued the former mayor's wife should have been allowed to testify.
