Kivalina suffers setback in global-warming lawsuit

Link: Constitutional Accountability Center A federal appeals court is backing a lawsuit by victims of Hurricane Katrina seeking damages related to global warming, while a California court has dismissed a similar suit by the storm-threatened Alaska village of Kivalina. Kivalina's lawsuit, charging that oil companies are conspiring to create a global-warming "nuisance" that is causing the village to disappear beneath rising sea levels, does not have "judicially discoverable and manageable standards," the court ruled. An appeal is expected.
