Wade trial delay ruling appealed

Lawyers for an Anchorage man accused of murdering a neighbor are asking for a delay in a trial involving the use of the dead woman's ATM card. Last week, a federal judge denied a request from Joshua Wade's attorneys that asked for a 90-day delay in his fraud case, saying there had been enough time for both sides to prepare.

Now the lawyers have taken their case to the 9th Circuit U.S. Court of Appeals.

The 29-year-old Anchorage man is accused of torturing and murdering his neighbor Mindy Schloss in 2007.

He could be sentenced to death if convicted in that trial.
