Calista named as co-defendant in woman's harassment suit

FIRED: Suit originally was filed against former chief executive.

Calista Corp. has been named as a co- defendant in a pending workplace sexual harassment lawsuit that recently led to the toppling of the Native corporation's longtime chief executive.

A former Calista employee filed the lawsuit against former chief executive Matthew Nicolai in August, accusing him of acting like a stalker and using his position within the company to hurt her professionally after she broke up with him in 2009.

The Calista board terminated and replaced Nicolai in early October after completing its own investigation of her allegations.

Emily Davenport, the former president of Calista subsidiary Solstice Advertising, filed the lawsuit against Nicolai on Aug. 12, two days after the company told her that she would be demoted. She was put on leave a week later and fired in September, according to her court filings.

This month, Davenport named Calista as a co-defendant in the state Superior Court case, accusing the company of wrongfully terminating her in September.

The company declined to comment on her filing, saying it is a company policy not to discuss lawsuits involving Calista. The regional Native corporation for Western Alaska represents more than 13,000 shareholders who have roots in the Yukon-Kuskokwim Delta region.

Davenport said in a court filing that she and her attorney met with Calista officials -- including Nicolai -- in September to work on a possible resolution of her claims and severance pay. But the meeting ended without an agreement. The same day, she was fired from her job, according to her court filing.

In the filing, she said the company fired her under false pretenses -- citing lackluster job performance. She also alleged that other members of Calista management were aware of Nicolai's "special attention" to her.

The case has been set for trial in Anchorage next September.
