Miller to announce appeal plans Friday

JUNEAU -- Republican Joe Miller plans to announce by Friday whether he'll continue his legal fight over the Senate race.

Miller spokesman Randy DeSoto says Miller is weighing his options. A news conference is planned for Friday in Anchorage.

Miller can appeal Tuesday's federal court decision. He also could protest the results of the election in state court. He has said he's willing to go to the U.S. Supreme Court but is taking legal steps one at a time.

Three state and federal courts have refused to overturn results favoring Sen. Lisa Murkowski, who mounted a write-in campaign after losing her primary to Miller. She is to be certified the winner today.

Miller argued the state should have followed a strict reading of the law in counting write-in ballots for Murkowski. Courts upheld the state's practice of using discretion to determine voter intent.
