State wants out of lawsuit against feds over trail access

FAIRBANKS -- A federal judge has inserted the state into a lawsuit over trail access. But the Alaska Department of Law says the state can't be forced into the dispute in federal court.

The Fairbanks Daily News-Miner says Carey Mills filed the lawsuit. Mills has rights to an 880-acre gold prospect near Eagle and is in the midst of a battle to gain access to the claim along a disputed trail.

The state previously has maintained that 657 trails in the state -- including the Fortymile Station-Eagle Trail alongside Mills' prospect -- are public rights-of-way and grandfathered in under a defunct federal law.

The state supports Mills' access to the trail but says it would have rather waited for a better case.
