An attorney for Fairbanks-area residents George Riley and Ron Dearborn says if a judge lets the borough drop the case, it should be with conditions -- giving remaining plaintiffs time to amend their pleadings and requiring the borough assembly to approve a motion for dismissal in an open meeting.
The decision was made in executive session.
The borough is seeking to support the case non-financially.
Three lawsuits filed over redistricting were consolidated into one. Riley, Dearborn and the city of Petersburg are the other plaintiffs. Petersburg didn't oppose the borough's request.
An assistant borough attorney says it's unclear whether new assembly members will seek to keep the borough as a plaintiff.
