Courts don't follow popularity

Mr. Tobin's letter to the Editor of Feb. 11, "Court's decision to strike down Proposition 8," shows a lack of understanding of the obligations of the judicial branch. Judges are not obliged to render decisions in accordance with the will of the people -- they are obliged to render decisions in accordance with the principles set forth in the U.S. Constitution.

The 9th Circuit Court of Appeals clearly did this with their decision regarding California's Proposition 8, citing the Due Process and Equal Protection clauses of the 14th Amendment. The only way that the will of the people can transcend the Constitution is by amending it. And I highly doubt that this country will ever see an amendment to the Constitution that says that one group of society has more or less rights than other groups of society.

That very idea is contrary to what this country stands for.
