Juneau man allegedly kicks down door, assaults one-legged woman

A 50-year-old Juneau man faces burglary and assault charges after, police say, he broke down his neighbor's door and dragged her down a flight of stairs because he was tired of hearing the woman talk.

Mark Smith has been charged with first-degree burglary and fourth-degree assault.

A Juneau Police Department officer wrote in the charges against Smith that the victim told police she'd been assaulted at her Bergmann Hotel apartment on the afternoon of Aug. 31.

Smith knocked down the woman's locked door, entered her room, beat her up and dragged her down the stairs, according to the charges.

The woman told police she did not know or associate with Smith.

The officer reported in the charges that the woman "had what appeared to be fresh injuries (scrapes) on her mouth, wrist and foot."

"The door to (her) room was open and damaged, with pieces of wood inside the room, the door jamb lying on the floor, and the deadbolt still in the locked position," the charges say.

Smith told officers he was tired of hearing the woman talk, "so he broke down her door and threw her down the steps," the charges said.

An assistant district attorney did not immediately return requests for comment Tuesday.

The charge of first-degree burglary, a felony, includes entering a building with the intent to commit a crime. It's punishable by up to 10 years in prison.

The Juneau Empire reported that police arrested Smith at the scene, and instead of taking him straight to jail, officers took him to Bartlett Regional Hospital to be committed. Police thought the extreme behavior indicated mental health issues, the newspaper reported.

A state prosecutor told the newspaper the alleged victim is over 60 years old and missing a leg. She gets around with canes, the prosecutor said.

Smith reportedly pleaded not guilty Monday during his arraignment. Public defender Grace Lee noted the crime seemed out of character for Smith since he lacks a criminal record, the newspaper reported.
