Alaska Mental Health Trust Authority Trust Land Office Public Notice under 11 AAC 99.050 Decision to Enter into Negotiated Mineral Lease TLO 2013-34 Pursuant to the provisions of AS 38.05.801 and 11 AAC 99, the Executive Director of the Alaska Mental Health Trust Land Office (TLO) has determined that it is in the best interest of the Alaska Mental Health Trust and its beneficiaries to enter into a negotiated mineral lease with Fairbanks Gold Mining Inc. on approximately 11,912 acres of Trust mineral estate. The area of interest is located near Ophir approximately 36 miles northwest of McGrath. The reasons for this determination are explained in a written best interest decision, prepared by the Executive Director pursuant to 11 AAC 99.040. The Trust land to be offered includes the mineral estate of Trust parcel K70185 further described as follows: all of MHT Parcel No. K70185, described as the Ophir Block, and further described as all or portions of Sec. 34 and 35, Township 27 South, Range 12 East, and within Sec. 1-4, 9-16, and 21-28, Township 28 South, Range 12 East, Kateel Meridian, Alaska. Parties wishing to comment on the written decision or parties that believe that the written decision should be altered due to an inconsistency with Trust management principles, or any other provision of 11 AAC 99, must provide written comments on or before 4:30pm on March 11, 2013. Following the comment deadline, all timely written responses will be considered and the Executive Director's best interest decision may be changed in response to such comments. To be eligible to file for reconsideration or subsequent appeal to the Superior Court, parties must have submitted written comments during the public notice period. Commenting parties will be provided a copy of the final best interest decision. Eligible parties will then be given twenty (20) calendar days after receipt of the written decision to request that the Executive Director reconsider the decision under 11 AAC 99.060(b).
