Court suspends lawyer's license

MARK AVERY: Guilty plea to 15 felony counts leads to panel's action.

Mark Avery, a former city and state prosecutor and onetime owner of the air charter business Security Aviation, can no longer practice law in Alaska. At least for now.

The Alaska Supreme Court temporarily suspended his law license April 17, about a month after he pleaded guilty to 15 felony counts in federal court.

Such suspensions happen whenever a lawyer is convicted of a felony or other serious crime, said Stephen Van Goor, counsel for the Alaska Bar Association.

"He's unable to practice. The only issue at a future hearing would be what the final disciplinary action would be," Van Goor said.

He could be disbarred, or face a long-term suspension. Most cases are resolved through agreement, but some go to a hearing, Van Goor said. The case should be finalized by September or October.

Avery also is licensed to practice in California. A state bar court there automatically suspends the license of lawyers convicted of a felony but that hasn't yet happened in Avery's case, said Donald Steedman, supervising trial counsel for the California Bar Association. He said the California Bar may not yet have learned of Avery's criminal case or his suspension in Alaska.

Lawyers are disbarred in California if they commit a crime of "moral turpitude," which includes crimes of dishonesty such as theft and fraud, Steedman said. Disbarment wouldn't happen until after sentencing, he said.

Avery pleaded guilty March 6 to five counts of wire fraud and 10 counts of money laundering. His sentencing is scheduled Sept. 25.

The criminal case involves what federal prosecutors describe as a scheme to defraud a wealthy widow of more than $52 million from her trust fund.

Avery and his family left Alaska and returned to his home state of California in October, just before he filed for bankruptcy. That case is ongoing.
